By using Clutch It, you agree to these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By accessing or using Clutch It, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Clutch It is NOT a Gambling Platform

📌 Clutch It is a sports analytics and data insights platform. We do NOT:
🚫 Process bets, wagers, or gambling transactions.
🚫 Facilitate deposits or withdrawals for betting.
🚫 Act as a sportsbook, casino, or gambling operator.

Clutch It provides AI-powered analytics, market insights, and user-generated betting strategies. All information provided is for informational and entertainment purposes only.

If you choose to place bets outside of Clutch It, you do so at your own risk.

3. No Guarantee of Wins & Gambling Responsibility

• Clutch It does NOT guarantee that you will win any bets or make a profit.
• AI predictions, analytics, and betting recommendations are for informational purposes only.

4. Subscription Plans & Credit System

Clutch It operates on a subscription-based model with a credit system for AI insights and bet uploads.

📌 Plan Features:

• Basic Plan ($10/month) → Buy expert picks, access AI insights. (Cannot sell picks)
• Premium Plan ($20/month) → Buy & sell picks, AI hedge alerts, leaderboard access.
• Unlimited Plan ($40/month) → Unlimited picks & uploads, advanced AI bankroll tracking.

📌 Credit Usage:

• Each plan provides monthly credits for AI predictions and bet uploads.
• Credits do not roll over and must be used within the billing cycle.
• Additional credits can be purchased separately.

🚫 No Refunds – All subscriptions and credit purchases are final and non-refundable.

5. The Vault – Buying & Selling Expert Picks

The Vault is a marketplace for digital sports betting insights.

📌 How It Works:

• Basic users can buy picks but cannot sell.
• Premium & Unlimited users can sell picks and earn money.
• Stripe handles all transactions securely.
• Clutch It takes a 10% commission on every pick sold.

📌 No Refunds on Picks:

• All purchases in the Vault are final.
• Clutch It does not guarantee the accuracy of picks sold by users.

6. Account & User Conduct

• You must be 18+ years old to use Clutch It.
• You may NOT share or resell your account.
• You are responsible for maintaining the security of your account.
• Violations of these Terms may result in account suspension or termination.

🚨 Prohibited Activities:
🚫 Uploading false or misleading picks.
🚫 Abusing the Vault marketplace (spamming, fraudulent sales).
🚫 Attempting to use Clutch It for illegal gambling activities.

7. AI Model & Data Usage

• By using Clutch It, you agree that we may collect and analyze your data (betting uploads, purchases, AI interactions) to improve our AI models.
• We may use anonymized data to enhance AI predictions, trend analysis, and market insights.

📌 Privacy First: We do not share personal user data with third parties.

8. Payment Processing & Security

• Stripe handles all subscription and marketplace transactions.
• Clutch It does not store your financial information.
• Clutch It is not responsible for Stripe transaction processing issues.

9. Limitation of Liability

• Clutch It is not responsible for financial losses, incorrect picks, or system errors.
• We provide information on an “as is” basis without guarantees or warranties.
• Clutch It shall not be liable for inaccuracies, service interruptions, or AI mispredictions.

10. Modifications to the Service

• We reserve the right to change, suspend, or discontinue any features at any time without prior notice.
• Subscription fees and feature availability may be adjusted at our discretion.

11. Governing Law

• These Terms are governed by and construed under the laws of the State of Florida, United States.
• Any legal disputes must be resolved in the courts of Florida.
